Cleybercan.travel offers a wide variety of experiences and private guiding services, available through its website, mobile site, and related applications, hereinafter referred to as “this website.” The purpose of this website is to help clients obtain information about private experiences and private guiding services in Mexico, as well as to search for and book experiences and services within the country.

The terms used on this page, including “we,” “us,” “our,” “ours,” and “cleybercan.travel,” refer to cleybercan.travel Private Guide, a brand owned by Cleyber Can, an individual with commercial activities based in Mexico City, Mexico.

This website and the products and services available through it are offered subject to your acceptance, without modification, of all the terms, conditions, and notices detailed herein, collectively referred to as the “Agreement.”

By accessing or using this website in any way, you accept this Agreement and acknowledge that you have read and understood all of its terms.

It is important that you read this Agreement carefully and become informed about your legal rights and the limitations of those rights, as well as review the section regarding applicable law and jurisdiction in the event of any dispute.

If you do not accept these Terms and Conditions, please do not use this website or pay for any product or service offered through it. In all booking agreements, the person making the reservation and all accompanying guests shall be deemed to have accepted these Terms and Conditions.

This Agreement may be modified in the future, and you understand and agree that your continued use of and access to this website after any modification constitutes acceptance of the updated or modified Agreement. We will record the date of the latest modification at the bottom of this page, and any revision will only be valid from the date it is published. We will always publish the modification and update date of this document in this section.

We reserve the right, at our sole discretion, to deny access to this website and to the services we offer to any person, at any time and for any reason, including, but not limited to, breach of this Agreement.

You and other users of our website may contribute to it in different ways, such as by sending emails, posting comments, and providing reviews.

You grant cleybercan.travel and its affiliates a worldwide, non-exclusive, royalty-free right over your content contributions. You acknowledge that cleybercan.travel may choose, at its discretion, whether to provide attribution for your comments or reviews. Likewise, you grant cleybercan.travel the right to take legal action against any person or entity that violates your rights or the rights of cleybercan.travel in relation to the content, due to breach of this Agreement.

You acknowledge and agree that the content is not confidential and that you do not own it. If it is determined that you retain moral rights, including rights of attribution or integrity, in the content, you hereby declare that: (a) you do not require any personally identifiable information to be used in connection with the content or any derivative works or updates; (b) you have no objection to the publication, use, modification, deletion, and exploitation of the content by cleybercan.travel or its licensees, successors, and assigns; (c) you waive and agree never to claim or enforce any moral rights in any of your content; and (d) you agree to forever release cleybercan.travel and its licensees, successors, and assigns from any claim you may have against cleybercan.travel based on such moral rights.

Cleybercan.travel and its affiliates may display advertisements and any other information related to or included in the website content. You are not entitled to any compensation for such advertisements. The form, style, and scope of advertising are subject to change without prior notice.

PRODUCTS AND RESERVATIONS

By booking a product or service through the website www.cleybercan.travel, you accept the practices described in our Privacy Policy. You also guarantee that you are over 18 years of age, that you have the legal capacity to enter into this Agreement, use this website, and book the product, and that all information provided is truthful and accurate.

You also agree to use the booking function of this website only to make legitimate reservations for yourself or for another person on whose behalf you are duly authorized to act.

False or fraudulent reservations are strictly prohibited under any circumstances.

If you book a private tour, private guide service, or experience through our website, you agree to review and be bound by the terms and conditions of our product and service providers, as well as their policies and rules related to their travel experiences. Your interaction with our providers is at your own risk. Cleybercan.travel is not responsible for the acts, omissions, errors, statements, warranties, breaches, or negligence of our providers, nor for personal injuries, death, property damage, or any other damages or expenses resulting from your interaction with our service and product providers.

TO MODIFY YOUR RESERVATION

All modifications and amendments to your reservation must be notified to the cleybercan.travel customer service team by email at hola@cleybercan.travel, using the same email address that you provided or used to make your reservation. We will process your request accordingly. Please note that chat and WhatsApp messages are not considered formal means of communication. Formal communication will always be carried out through the email address hola@cleybercan.travel.

It is important that you review the “Payments and Cancellations” section for additional information regarding the cancellation, modification, or amendment of your reservation.

Cleybercan.travel does not charge any fee to modify or change the date of an existing reservation, provided that the request is received by our customer service team at least three days before the start of your tour or service. The applicable time shall be Mexico City time.

It is not possible to change or modify tickets for special events such as hot air balloon flights, light and sound shows, temazcal experiences, spa services, lucha libre, skydiving, hang gliding, paragliding, sailing trips, yachts, certain museums, theater, or any other show or special event. The purchase of these tickets is non-refundable and cannot be modified once confirmed.

Cleybercan.travel cannot guarantee the success of any date change request.

If you request a date change within 48 hours prior to your trip or service, based on Mexico City time, cleybercan.travel will attempt to accommodate your request. These changes may be subject to an additional fee. Changes made 48 hours or less before the original travel date may also be subject to an additional charge. For multi-day trips that include hotel nights, confirmed date changes may also be subject to additional charges.

If you make a reservation or purchase using a promotional code, cleybercan.travel may invalidate your discount or promotional price if you request changes or modifications to your itinerary. If you are not satisfied with the alternatives offered, you are entitled to receive a refund, less any credit card and payment intermediary fees, if applicable.

However, when our providers inform us in advance of a significant change to a reservation, visit, product, or event, we make every effort to notify our clients and modify or cancel the reservation as soon as possible. In such cases, if you are not satisfied with the alternatives offered, you are entitled to a refund, less any credit card and payment intermediary fees, if applicable.

If you have any personal or business activity, or another trip scheduled on the day of your excursion, visit, or experience, you must notify us at hola@cleybercan.travel of the time by which you need to return to the starting point. Cleybercan.travel will make every effort to help you return on time; however, cleybercan.travel is not responsible for incidents beyond our control, including orders from authorities, rain, flooding, snow, emergency roadblocks, closed roads, heavy traffic, or any other situation beyond our control.

PRICES, INCLUSIONS, AND EXCLUSIONS

The prices published on our website apply to private tours or private guiding services for groups of no more than seven people or passengers, unless otherwise stated. Prices are based on the local rate in effect at the time of the quotation, converted at the current exchange rate determined by cleybercan.travel.

The prices listed are subject to change without prior notice until the reservation is confirmed, unless otherwise specified.

Prices do not include tips, personal items, luggage, loss of photography or video equipment, insurance, personal insurance of any kind, or the payment of fines for violations of Mexican laws. In the specific case of restaurants, when included in your tour or reservation, only the meals and beverages specified on the selected restaurant menu are included.

PAYMENTS AND CANCELLATIONS

When making a reservation through our website, cleybercan.travel collects your payment information and processes it as described in the “Payment Processing” section. Cleybercan.travel accepts the following credit cards: Mastercard, Visa, American Express, and Discover, as well as the global payment platform PayPal.

Credit or debit card payment processing is free of charge. To make a reservation, full payment or a deposit to hold the date and time is required, depending on the specific experience you choose, and may be paid by credit card, debit card, or PayPal. The payment may appear on your card statement as cleybercan.travel Private Guide or BTUVI.travel Private Tours, an associated company.

Once the reserved tour or service has started, no refunds will be issued. The same applies to food, lodging, or any other contracted service.

If, after 20 minutes of waiting, you do not arrive at the meeting point or at the hotel reception indicated as your pickup location, the excursion or service will be automatically canceled.

Please note that cleybercan.travel gift coupons or certificates may be confiscated and immediately canceled without refund if your signature and/or name do not match those on your credit or debit card or identification document.

For security reasons, you must always show us an identification document and allow us to photograph it. You must also sign the trip or service start form before beginning your experience.

You must cancel only in writing from the email address you provided when making your reservation. Please contact us through www.cleybercan.travel, and the cancellation policies and the Terms and Conditions of this document will apply to any refund.

If, in accordance with these Terms and Conditions, your cancellation is approved, we will notify you by email of the total refund amount you will receive.

The standard cancellation policy shall apply under the following conditions:

A 100% refund applies to cancellations made at least 48 hours before the start of the tour or service, based on Mexico City time. You will receive the refund to your credit card, less any fees charged by your bank and payment intermediaries involved in the transaction and transfer to our account.
Cancellations made within 24 hours prior to the start of the tour or any service contracted with cleybercan.travel, based on Mexico City time, will not receive any refund.

The transaction value may be subject to taxes, duties, international transaction fees, exchange rates, or other charges. Your bank or credit card company may convert the payment into your local currency and apply charges. If there is any difference between the amount shown on www.cleybercan.travel and the final amount charged to your bank account, we recommend that, in case of doubt, you contact your bank, payment platform, or credit card company to ask about the applicable exchange rate or fee.

Please note that some countries apply charges to foreign financial transactions, and these taxes are not included in the final reservation value and may be charged to the credit or debit card used to make the reservation.

PAYMENT PROCESSING

The payment processing service for products purchased on this website is provided by cleybercan.travel. If you pay by credit card, debit card, or payment platform, the payment is processed through online payment receiving companies or banks that charge a fee for this service and subsequently deposit the funds into the bank account of cleybercan.travel, BTUVI.travel, or the legally authorized person, referred to in Mexico as an individual or individual with commercial activity. For any type of credit card payment, these terms constitute an agreement between you, the individual with commercial activity, and cleybercan.travel.

Cleybercan.travel will handle reservations and coordination. Service providers, contracted products, and tourist guides shall be responsible for the quality and excellence of their own services and products.

In the specific case of tourist guide services or travel experiences provided by the individual Cleyber Can, payment may be made by credit card or in cash at the meeting point before the service or experience begins.

In exceptional cases, cleybercan.travel or BTUVI.travel may charge for services outside the platform by direct bank transfer to our account or in cash. However, in such exceptional cases, all cleybercan.travel services shall remain subject to the same Terms and Conditions.

PASSPORTS, VISAS, AND INSURANCE

By making a reservation on this website, you are responsible for complying with all requirements to enter Mexico. All of your travel documents, including passport and visa, must be in order. To verify passport and visa requirements, please consult the Mexican embassy or consulate in your country, as requirements may change at any time. Be sure to verify updated information before making your reservation and before departure.

Cleybercan.travel assumes no responsibility for travelers who are denied entry into Mexico because the traveler does not carry the documents required by the airline, authority, or country.

Because visa and health requirements are subject to change without prior notice, we recommend verifying them with the Mexican consulate or embassy in your country before departure. Likewise, it is your responsibility to consult a physician regarding current vaccine recommendations before traveling to Mexico and to ensure that you comply with all health requirements and follow all medical instructions related to your trip.

We strongly recommend purchasing medical insurance for your trip to Mexico before leaving your country. Your medical insurance may cover expenses arising from a medical emergency. Please read your travel medical insurance policy carefully.

Although most trips take place without incident, some destinations may involve greater risks than others. Cleybercan.travel recommends that passengers research and verify all travel prohibitions, warnings, and recommendations issued by their own government and by the Mexican government before booking an international trip.

Cleybercan.travel does not guarantee that any private tour, private guiding service, or destination mentioned is advisable or risk-free, and shall not be responsible for damages or losses.

Please read this section carefully. This section limits the liability of cleybercan.travel to you for any problem that may arise in connection with the use of this website. If you do not understand the terms of this section, please consult an attorney before accessing or using this website.

The information, content, software, products, and services published on this website may contain inaccuracies or errors, including reservation availability and pricing errors.

Cleybercan.travel and its service and product providers do not guarantee the accuracy or availability of the information on this website, including prices, availability, photographs, features, inclusions, exclusions, general product descriptions, reviews, and ratings. Cleybercan.travel has no responsibility and will not issue refunds in the event of causes beyond its direct control, whether social or natural, and has no responsibility for any act or decision by a government, state, or any authority.

You agree to indemnify cleybercan.travel and all of its officers, directors, and employees against any claim, cause of action, lawsuit, judgment, investigation, loss, damage, fine, penalty, fees, expenses, costs, and any other liability of any kind or nature, including legal and accounting fees, arising from breach of this Agreement or the documents referenced herein, violation of any law, rule, or regulation, or misappropriation of third-party rights, negligence, or misconduct in Mexico.

You hereby accept the exclusive jurisdiction and venue of the courts of Mexico City and acknowledge the fairness and convenience of proceedings in such courts for any dispute that may arise from or be related to the use of this website.

You agree that any claim you may have against cleybercan.travel or the individual Cleyber Can must be heard and resolved in a competent court located in Mexico City. The use of this website is not authorized in any jurisdiction that does not recognize the validity of all provisions of these Terms and Conditions.

CURRENCY CONVERTER

The cleybercan.travel website and other applications may offer a currency converter, although exchange rates are based on various public sources and should be used for reference only. Rates are not verified and may vary. Quotes are not updated daily.

The information provided by this application is considered accurate; however, cleybercan.travel and/or its affiliates and providers do not guarantee such accuracy. The currency converter is used only to calculate the price of your reservation. If you have questions about exchange rates, we recommend consulting a qualified professional to verify the accuracy of the converter.

GENERAL PROVISIONS

You agree that no joint venture, agency, or partnership exists between you and cleybercan.travel as a result of this Agreement or your use of this website.

Compliance with this Agreement is subject to current laws and legal processes, and nothing contained in this Agreement limits our right to comply with the law or with other governmental requests or requirements.

To the extent permitted by applicable Mexican laws, you agree that you will bring any claim or cause of action arising from or related to access to or use of this website within two years from the date on which such claim arose, or such claim shall be waived.

If any part of this Agreement is found to be invalid or unenforceable under applicable law, it shall be deemed replaced by a valid and enforceable provision that most closely matches the intent of the original provision. The remaining provisions of the Agreement shall remain valid.

This statement and any other Terms and Conditions referenced herein constitute the entire Agreement between you and cleybercan.travel regarding this website and supersede all prior and current communications and proposals, whether electronic, oral, or written, between the client and cleybercan.travel regarding this website.

A printed version of this Agreement and any other electronic notice shall be admissible in judicial and administrative proceedings based on this Agreement, subject to the same conditions as other commercial documents and records originally generated and maintained in printed form.

All rights not expressly granted herein are reserved. These Terms and Conditions may be modified at any time and without prior notice. The same conditions in effect at the time shall apply to each individual contract.

These general Terms and Conditions constitute the entire agreement between cleybercan.travel, Cleyber Can as Tourist Guide, and the user, and there is no additional agreement.
